South Carolina recognizes the Collateral Source Rule which states the at-fault party cannot benefit from the fact that you have used your health insurance to seek treatment and now may be responsible for a bill balance that is less than the amount of the original medical bill. For example, the at-fault party’s insurance company cannot extend a lower settlement amount or pay you less money because you have elected to take advantage of using your health insurance (collateral source) for your treatment.
